The rules, rights, and responsibilities that govern your use of Thentic Pay's crypto payment infrastructure and services.
By registering a merchant account, accessing the Thentic Pay dashboard, using our payment pixel, or calling our API, you ("Merchant", "you") agree to be bound by these Terms of Use ("Terms") and our Privacy Policy.
If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity. If you do not agree to these Terms, you must not use the Service.

By using Thentic Pay, you represent and warrant that you meet all eligibility requirements.
To access the Service, you must register by providing your name and email address. Upon registration, a unique 28-character Merchant ID is generated and sent to your email. This ID serves as your account credential.
Your Merchant ID is your sole means of authentication. You are responsible for keeping it confidential and secure. You must notify us immediately at eb@thentic.tech if you suspect unauthorised access or loss of your Merchant ID.
You agree to provide accurate, complete, and current registration information. Registering multiple accounts is not permitted. We reserve the right to suspend or terminate accounts based on false, inaccurate, or misleading information.
Only one merchant account may be created per email address. Registration is rate-limited to prevent abuse.
You may use Thentic Pay only for legitimate commercial purposes â to accept cryptocurrency payments from your customers for lawful goods and services. You agree to:

Thentic Pay facilitates on-chain cryptocurrency transactions. When a payment is initiated, the transaction data is constructed and signed by the payer's wallet. Funds are transferred directly on the blockchain to the recipient address specified by you.
We do not at any point take custody of your funds. We do not hold, escrow, or intermediate funds. All payments are peer-to-peer on the blockchain network.
Blockchain transactions are generally irreversible once confirmed on-chain. You are solely responsible for verifying the accuracy of recipient addresses and transaction details before creating payment requests. We are not liable for funds sent to incorrect addresses.
Thentic Pay may apply an optional commission to payment amounts when the include_commission parameter is used. The applicable commission rate is displayed in the API response. Network gas fees are the payer's responsibility and are separate from any Thentic Pay commission.
The availability of specific tokens and blockchain networks may change over time. We do not guarantee the continued availability of any particular token or chain.
Thentic Pay supports recurring payment subscriptions (daily, weekly, or monthly) using ERC-20 token approvals. When a payer approves a subscription:
As a merchant, you are responsible for clearly communicating subscription terms (amount, frequency, cancellation policy) to your customers before they approve a subscription. Failure to do so may constitute a consumer protection violation in your jurisdiction.
Thentic Pay operates a mandatory dual-screening system for all recipient wallet addresses:
Transactions where the recipient address matches a sanctions entry are automatically and permanently blocked. We are not liable for blocked transactions where the recipient address is found on a sanctions list.
By using the Service, you confirm that you are not, and that the recipient addresses you submit are not, subject to any applicable sanctions.
API endpoints are rate-limited to protect service availability for all users. The payment creation endpoint is currently limited to 15 requests per minute per IP address and per merchant account. Exceeding rate limits will result in a 429 error response.
API access is granted solely for integrating Thentic Pay into your own legitimate applications. You may not resell API access, offer competing services built solely on our infrastructure without authorisation, or use the API in any way that violates these Terms.
Webhook URLs you register must be your own endpoints. You are responsible for securing your webhook endpoints and handling duplicate notifications gracefully. We do not guarantee webhook delivery and recommend polling the API as a fallback.
Custom parameters passed through payment requests must not contain personal data beyond what is necessary for your order management. You are responsible for handling any personal data within custom parameters in accordance with applicable privacy law.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure at all times.
We are not liable for any losses arising from blockchain network failures, high gas fees, transaction reversions, smart contract vulnerabilities, or the irreversibility of on-chain transactions.
To the maximum extent permitted by applicable law, Thentic Pay's total liability to you for any claim arising out of or relating to the Service shall not exceed the total fees paid by you to us in the three months preceding the claim. We are not liable for indirect, consequential, incidental, or punitive damages.
You agree to indemnify and hold harmless Thentic Pay and its operators from any claims, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
You may stop using the Service at any time. To request deletion of your account and associated data, contact us at eb@thentic.tech. Transaction records may be retained for legal compliance purposes as described in our Privacy Policy.
We reserve the right to suspend or terminate your access to the Service, with or without notice, if we believe you have violated these Terms, engaged in fraudulent or illegal activity, or if required to do so by applicable law or a competent authority.
Upon termination, your right to access the Service ceases. Sections of these Terms that by their nature should survive termination (including liability, indemnification, and governing law) shall survive.
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.
Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Germany. If you are a consumer in the EU, you may also benefit from mandatory consumer protection provisions of the law of your country of residence.
The European Commission provides an online dispute resolution platform available at ec.europa.eu/consumers/odr. We are not obligated to participate in alternative dispute resolution but will consider reasonable requests.
We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. When we make material changes, we will update the "Last updated" date at the top of this document.
Continued use of the Service after updated Terms are posted constitutes your acceptance. If you do not agree to the revised Terms, you must stop using the Service and may request account deletion.
For significant changes, we will make reasonable efforts to notify registered merchants via the email address on their account.
